AmFin Claims 'Egregious' Discovery Misdeeds By FDIC

Law360, New York (May 14, 2014, 6:36 PM EDT) -- AmFin Financial Corp. on Wednesday asked an Ohio bankruptcy judge to penalize the Federal Deposit Insurance Corporation for “egregious” discovery violations, saying certain claims of the agency should be dismissed or subordinated.

The defunct holding company said that FDIC, which was appointed as receiver for AmFin’s bank unit, has irreparably obstructed discovery over 4 1/2 years of contentious litigation between the two parties, by failing to search dozens of undisclosed databases in its possession in response to AmFin’s requests.
