High Court Denies Retailers' Bid To Nix Gender-Based Tariff

Law360, New York (May 19, 2014, 1:53 PM EDT) -- The U.S. Supreme Court on Monday refused to hear appeals from clothing importers Rack Room Shoes Inc. and Forever 21 Inc., again denying attempts to challenge the federal government’s gender-based tariff rates on clothing and footwear.

The importers have been trying to prove U.S. tariff rates are unconstitutional if they're based on gender or age, but the appeal had come down to the pleading requirements to bring an equal protection claim. Last June the Federal Circuit ruled that they had failed to meet their baseline pleading...
