FTC Tries Again To Stop Whole Foods Merger

Law360, New York (April 23, 2008, 12:00 AM EDT) -- The future of Whole Foods Market Inc.'s $565 million acquisition of rival Wild Oats Markets Inc. is now in the hands of an appellate court, following arguments Wednesday over the U.S. Federal Trade Commission's request to stop the deal.

In an unusual hearing before a panel of the U.S. Court of Appeals for the District of Columbia Circuit, the FTC argued that while the deal is consummated, it is not too late to halt the process and place restrictions on the transaction.
