Jury Awards Software Co. $1.7M In Libel Suit Against Rival
Law360, Los Angeles (May 23, 2014, 8:26 PM EDT) -- A North Carolina federal jury on Friday awarded a self-storage software company $1.7 million, finding that EMove Inc. caused rival SMD Software Inc. to lose business by misleading customers about its product in violation of the Lanham Act.
The jurors ruled that, on most items in a brochure advertising EMove's self-storage management software, EMove misled customers about how its software measured up against SMD, according to the verdict. The jurors found that SMD lost customers as a result, and awarded the plaintiff $1.7 million, according to the decision turned in Friday.
