Judge Grants IBM Motion to Compel Discovery in SCO's Linux Suit

Law360, New York (December 7, 2003, 12:00 AM EST) -- A federal judge presiding over SCO Group’s lawsuit against IBM over intellectual property rights to the Linux operating system Friday granted IBM’s motion to compel discovery, handing IBM an early tactical victory.

Judge Dale A. Kimball U.S. District Court in the District of Utah granted IBM’s motion, which would force SCO to show within 30 days the Linux software to which it believes it has rights and to point out where it believes IBM is infringing.
