Pharmacists' Right To Refuse Plan B Upheld

Law360, New York (May 2, 2008, 12:00 AM EDT) -- A federal appeals court has kept intact a preliminary injunction against a Washington state regulation that would prohibit pharmacies from refusing to fill prescriptions for emergency contraceptives on religious grounds.

The state had asked the U.S. Court of Appeals for the Ninth Circuit to stay the district court's preliminary injunction. But the court found little evidence that delaying the regulation would seriously diminish access to morning-after pills, such as Plan B.
