Enel Hopes For Investigation Into French Merger

Law360, New York (March 2, 2006, 12:00 AM EST) -- In an effort to prompt an investigation into a planned merger between two French energy giants, the Italian utility company Enel sent a memorandum to the European Commission Thursday.

Italy alleges France instigated a merger between two domestic utility companies, Gaz de France and Suez, in an economic protectionist attempt to foil a potential bid from Italian rival Enel. Italy argues that the French government disregarded EU regulations on the free transfer of capital in order to establish a French merger.
