Co-Counsel Joins Outcry Over Fees In Guidant MDL

Law360, New York (May 7, 2008, 12:00 AM EDT) -- A co-lead counsel in the settled multidistrict litigation over Guidant Corp.'s implantable defibrillators joined more than 10 plaintiffs firms Tuesday in opposing the proposed distribution of attorneys' fees in the case, saying the plan is inequitable and should be redrawn.

The Common Benefit Attorney Fee and Cost Committee, which included a number of the leading plaintiffs firms in the case, did not proportionately distribute the fees among the firms and based the amounts on flawed calculations, said Seth R. Lesser, a co-lead counsel in the litigation....
