Appeals Court Reinstates Suit Against Pacificorp

Law360, New York (May 7, 2008, 12:00 AM EDT) -- An appeals court ruled Wednesday that two Pacificorp employees can proceed with their lawsuit alleging the company fired them because of the cost of treating their son's fatal brain tumor.

The court ruled that the couple, William and Debra Trujillo, could proceed with claims under the Americans with Disabilities Act and the Employee Retirement Income Securities Act, reversing and remanding for further consideration the district court's summary judgment for the Portland, Ore-based company on both claims.
