Poultry Producers Must Face Leukemia Claims

Law360, New York (May 9, 2008, 12:00 AM EDT) -- The Arkansas Supreme Court has ruled that fumes from arsenic-laden chicken litter likely caused a man to develop a rare form of leukemia and has remanded the case for trial.

The high court said in the ruling, handed down Thursday, that Washington County Circuit Judge Kim Smith erred in granting summary judgment in favor of poultry producers Tyson Foods Inc., George's Farms Inc., Peterson Farms Inc. and Simmons Foods Inc.
