Limiting Choice Of Venue In Patent Litigation

Law360, New York (July 28, 2014, 10:12 AM EDT) -- A major complaint of defendants in patent litigation is the cost and inconvenience of litigating in a distant forum, especially in cases filed by patent assertion entities. Proposals to limit the venue for patent litigation or ease transfers to other districts have been considered in recent years, and it appears likely one or more such proposals will be considered for inclusion in upcoming patent litigation reform bills.

We suggest that Congress should consider whether the pre-1988 venue limits should be revived in patent litigation for defendants...
