9th Circuit Upholds Dismissal Of Fraud Suit

Law360, New York (May 12, 2008, 12:00 AM EDT) -- Lambasting a Las Vegas federal prosecutor for withholding 650 pages of important documents in a 2003 stock fraud case, the U.S. Circuit Court of Appeals for the Ninth Circuit has upheld the lower court's dismissal of all 64 charges against two lawyers.

The court rebuked the Nevada U.S. attorney's office for a series of discovery violations in the suit, which accused attorneys Daniel Chapman and Sean Flanagan and three other men of a $12 million securities fraud scheme and ended in mistrial.
