DSW Sues Zappos.com For Trademark Infringement

Law360, New York (May 13, 2008, 12:00 AM EDT) -- National footwear retailer DSW Inc. has accused Zappos.com Inc. of infringing its trademarks by using DSW service marks to lead customers to believe they were buying shoes from a DSW Web site.

The suit, filed Monday in the U.S. District Court for the Southern District of Ohio, accuses Zappos and online advertising firm Commission Junction Inc. of service mark infringement, false designation of origin, unfair competition and deceptive trade practices.
