Fed. Circ. Revives Stryker-Acumed Nail Patent Case

Law360, New York (May 13, 2008, 12:00 AM EDT) -- Finding that a district judge misinterpreted case law on claim preclusion, the U.S. Court of Appeals for the Federal Circuit has reversed the dismissal of a patent suit brought by Acumed LLC against Stryker Corp. over a nail used to treat bone fractures.

Judge Anna J. Brown of the U.S. District Court for the District of Oregon dismissed Acumed's complaint against Stryker in 2006, ruling that Acumed was precluded from litigating claims it could have raised in a prior action.
