9th Circ. Grants L.A. Biomed New Graft Patent Trial

Law360, New York (May 15, 2008, 12:00 AM EDT) -- An appeals court on Thursday granted the University of California's Los Angeles Biomedical Research Institute a new trial in a dispute over the ownership of heart-grafting patents, after ruling that the jury instructions in the original case contained a number of prejudicial errors.

The suit, filed by L.A. Biomed against Dr. Geoffrey White and Edwards Lifesciences LLC in the U.S. Court of Appeals for the Ninth Circuit, arose out of a patent infringement case between Edwards Lifesciences and Medtronic Inc.
