FERC Policy Revisions To Strengthen Enforcement

Law360, New York (May 16, 2008, 12:00 AM EDT) -- The U.S. Federal Energy Regulatory Commission on Thursday revealed a group of reforms updating its enforcement procedures, hoping the latest revisions following the Energy Policy Act of 2005 will strengthen its enforcement program.

FERC’s latest reforms include a revised policy statement on enforcement that expands upon current enforcement procedures and information, an interpretative order expanding the areas in which FERC will allow the no-action letter process, a notice of proposed rule-making clarifying off-the-record contacts and the separation of functions in enforcement investigations, and a final rule...
