$1B Bard Graft Patent War Must End, Gore Tells Fed. Circ.

Law360, Washington (August 8, 2014, 3:18 PM EDT) -- W. L. Gore & Associates Inc. asked a Federal Circuit panel Friday to nix its long-running patent infringement spat with C.R. Bard Inc. over blood vessel graft patent infringement, claiming Bard lacked jurisdiction to bring the billion-dollar case in the first place.

Although the patent battle between Gore and Bard has already gone through a Federal Circuit appeals process once before, which ultimately revised the court's willfulness standard, Gore claims that both the appeals court and an Arizona federal court never had jurisdiction to hear the case and Bard didn't have standing to bring the infringement suit.
