Section 337: A Thoroughly International IP Statute

Law360, New York (May 16, 2008, 12:00 AM EDT) -- Over the past seven years, there has been a dramatic increase in Section 337 investigations, both those brought by U.S.-based complainants and by non-U.S.-based complainants.

While the total number of complaints instituted annually doubled from 17 to 35 in the period 2000-2007, non-U.S.-based complainants increased their share during this period from zero to 28%, with a high of 33% in 2005 when 29 new complaints were instituted.
