10th Circuit Upholds Migrating Gas Dispute Dismissal

Law360, New York (May 19, 2008, 12:00 AM EDT) -- A federal appellate court has affirmed a lower court ruling that dismissed a dispute between two Midwestern natural gas companies over allegedly migrating gas in Kansas.

In a 2-1 decision Monday, the U.S. Court of Appeals for the Tenth Circuit affirmed a district court ruling of summary judgment in favor of Nash Oil & Gas Inc. after agreeing with the lower court that claims of conversion and unjust enrichment brought by Northern Natural Gas Co. were barred by the statute of limitations.
