Suit Over GM's Pre-Employment Physical Revived

Law360, New York (May 20, 2008, 12:00 AM EDT) -- The U.S. Court of Appeals for the Sixth Circuit has parted ways with an Ohio district court, ordering that a couple's negligence suit against General Motors Corp. over a pre-employment physical be reinstated and removed to state court.

On Tuesday, the Sixth Circuit sided with plaintiffs Julie and David Brittingham, giving new life to their long-standing accusations that the world's largest automaker suppressed information that could have enabled the couple to discover Julie Brittingham's lung cancer years earlier.
