Butamax Denied Attys' Fees In Gevo Patent Row

By Kat Greene (August 26, 2014, 8:32 PM EDT) -- A Delaware federal judge on Tuesday refused to award attorneys' fees to the BP PLC and DuPont joint venture Butamax Advanced Biofuels LLC, finding that its victory in a recent infringement suit over technology for an ethanol fuel alternative wasn't exceptional.

U.S. District Court Judge Sue Robinson ruled that Gevo Inc. hadn't pointlessly filed suit against its rival the day Butamax's patents for the biofuel issued, noting that the already extensive litigation between the two shows that the lawsuit wasn't meritless, according to the decision.
