Federal Circuit Weighs In On Declaratory Jurisdiction

Law360 (March 16, 2006, 12:00 AM EST) -- The U.S. Court of Appeals for the Federal Circuit has overturned a ruling in favor of circuit maker Microchip Technology Inc., on the grounds that the federal district court in Arizona did not have jurisdiction to issue a declaratory judgment.

On Wednesday, the Federal Circuit flipped the lower court’s ruling, siding with the defendant, the Chamberlain Group Inc., in a long-standing patent case involving garage door technology.
