3rd Circuit Rejects Isolagen Appeal As Premature

Law360, New York (May 27, 2008, 12:00 AM EDT) -- An appeals court has refused to consider the appeal of a lower court's decision dismissing a derivative lawsuit against biotechnology company Isolagen Inc., saying the appeal was premature because the district court's decision was not sufficiently final.

In a decision Thursday, a three-judge panel of the U.S. Court of Appeals for the Third Circuit said that the order, issued by Judge Ronald L. Buckwalter of the U.S. District Court for the Eastern District of Pennsylvania, was not a final order so the circuit court lacks jurisdiction...
