Supreme Court OKs Federal Age-Retaliatory Claims

Law360, New York (May 27, 2008, 12:00 AM EDT) -- The U.S. Supreme Court ruled on Tuesday that the federal-sector provision of the Age Discrimination in Employment Act allows federal employees to file court claims for retaliation based on age bias.

In a 6-3 decision, the court overturned a U.S. Court of Appeals for the First Circuit decision that held the ADEA did not allow retaliation claims by public employees since the statute did not expressly indicate such claims were allowed.
