9th Circ. Rebuffs Challenge To EPA Review Process

Law360, New York (May 28, 2008, 12:00 AM EDT) -- The U.S. Court of Appeals for the Ninth Circuit has rejected a challenge to the review process used by the U.S. Environmental Protection Agency in regulating water pollution, maintaining that the agency has met the obligations laid out by the Clean Water Act.

The Ninth Circuit ruled Friday against environmental advocates Our Children's Earth Foundation and Ecological Rights Foundation and upheld the district court's earlier decision in favor of the EPA.
