Citing Ledbetter, Judge Nixes ADEA Suit Against FAA

Law360 (May 28, 2008, 12:00 AM EDT) -- A federal judge has tossed a putative class action accusing the Federal Aviation Administration of discriminating against its older employees by denying them annual increases in base salary and benefits granted to younger employees.

Judge Paul L. Friedman of the U.S. District Court for the District of Columbia handed down his opinion Wednesday after dismissing the suit in March. He said that the complaint is time-barred because the plaintiffs contacted the Equal Employment Opportunity Commission more than 45 days after the alleged discrimination occurred.
