Florida Court Revives Thousands Of Asbestos Suits

Law360, New York (May 29, 2008, 12:00 AM EDT) -- A Florida state court has ruled that a 2005 Florida law cannot retroactively block lawsuits claiming asbestos injury, potentially allowing thousands of such suits to go forward.

The law, known as the Florida Asbestos and Silica Compensation Fairness Act, says that plaintiffs must show that they are suffering a malignant illness or physical impairment as a result of asbestos exposure in order to bring a lawsuit. The law was intended to apply retroactively to all cases filed in the state.
