Energy Drink Co. Calls Monster A 'Trademark Bully'

Law360, New York (September 15, 2014, 7:12 PM EDT) -- Trademark happy Monster Energy Co. was hit with a preemptive lawsuit on Monday over a threat letter it sent to a small Montana drink maker — a suit that calls Monster a “trademark bully.”

Victory Energy LLC is seeking a declaratory judgment that its 16-ounce cans of 'Victory Energize' don't infringe Monster's trademarks or trade dress, a move it said it felt was necessary after getting a cease and desist letter from the bigger drink maker.
