Drug Stores Allege Ovcon Antitrust Conspiracy

Law360, New York (March 21, 2006, 12:00 AM EST) -- Spearheaded by Walgreen Co., a group of pharmacy chains has smacked Warner Chilcott Holdings and Barr Pharmaceuticals Co. with an antitrust lawsuit, accusing the two drug companies of conspiring to keep prices high for the oral contraceptive Ovcon.

Last Thursday, the seven plaintiffs filed suit in U.S. District Court for the District of Columbia, attacking Warner Chilcott and Barr for denying them the benefits of generic competition.

Eckerd Corporation, Maxi Drug Inc., the Kroger Co., Albertson’s Inc., Safeway Inc. and Hy-Vee Inc. joined with Walgreen Co....
