Dalkon Shield Plaintiff's Malpractice Claims Remanded

Law360, New York (June 3, 2008, 12:00 AM EDT) -- An appeals court has vacated a summary judgment award in favor of a lawyer and his firm who were sued for malpractice by a woman they represented in a long-running product liability case against Dalkon Shield over faulty intrauterine devices.

On Tuesday, a three-judge panel of the U.S. Court of Appeals for the Second Circuit remanded plaintiff Barbara Rubens' case to district court to assess whether attorney Roy Mason's alleged acts of negligence were the proximate cause of her injuries.
