Appeals Court Reverses ADA Ruling

Law360, New York (June 3, 2008, 12:00 AM EDT) -- An appeals court has reversed a lower court's finding that an employee did not adequately show that Crown Cork and Seal Company Inc. discriminated against him because he is physically impaired by balance problems following a stroke.

In a decision Tuesday, a three-judge panel of the U.S. Court of Appeals for the Tenth Circuit reversed and remanded the summary judgment finding of the U.S. District Court for the District of Wyoming in the Americans with Disabilities Act case filed by David M. Justice.
