Judge Refuses Boston Scientific Bid To Toss Jury Verdict

Law360 (March 28, 2006, 12:00 AM EST) -- A federal judge this week denied a bid by medical device maker Boston Scientific Corp. to overturn a jury verdict that its NIR stent - which is no longer on the market - infringes on a patent held by Johnson & Johnson.

Chief Judge Sue L. Robinson also denied J&J’s motion to reinstate a prior damages verdict, ruling that the issue will be deferred until all liability issues are settled because “a new damages trial may be necessary,” according to court documents.
