$79M Philip Morris Verdict Heads Back To High Court

Law360, New York (June 9, 2008, 12:00 AM EDT) -- A tug-of-war between the U.S. Supreme Court and the Oregon Supreme Court over a $79.5 million punitive damages award to the estate of a former smoker is headed back to the Supreme Court.

The U.S. Supreme Court has twice overturned the punitive damages award against Philip Morris USA, only to have it reinstated both times by the Oregon Supreme Court. On Monday, the high court agreed to hear another appeal by the cigarette maker, now part of the Altria Group Inc.
