Law360, New York (June 16, 2008, 12:00 AM EDT) -- The U.S. Supreme Court has agreed to hear an appeal brought by the U.S. Department of Veterans Affairs that raises questions about whether the government or the veteran carries the burden of proof when arguing that the VA committed a prejudicial error when processing a veteran’s claim.
The court granted certiorari in the case on Monday after considering the petition filed by Secretary of Veterans Affairs James B. Peake at a conference on June 12.
