High Court Asks SG For Opinion On Asbestos Case

Law360, New York (June 16, 2008, 12:00 AM EDT) -- The U.S. Supreme Court has requested the U.S. solicitor general's view on the constitutionality of an Ohio state law that requires claimants to prove illness from asbestos exposure before filing claims under the Federal Employees Liability Act.

The petition for certiorari was filed by Charles Weldon and three other petitioners in March. It appeals the Supreme Court of Ohio's reversal of an appeals court’s ruling that federal law preempted Ohio's evidentiary statutes.
