Federal Circuit Revives Patent Correction Suit, Again

Law360, New York (June 16, 2008, 12:00 AM EDT) -- An appeals court has revived a long-running patent battle between two pharmacy service companies over a chemical solution used in heart surgery, clarifying the court's earlier ruling that the case should continue under the original, uncorrected claims for the patent-in-suit.

The U.S. Court of Appeals for the Federal Circuit ruled Monday that Central Admixture Pharmacy Services Inc. was entitled to pursue its infringement claim against rival Advanced Cardiac Solutions PC, reversing the lower court's dismissal of the case.
