Trans Pacific Can’t Stop FERC Petition: 10th Circ.

Law360, New York (June 17, 2008, 12:00 AM EDT) -- A federal appeals court has rejected Trans Pacific Oil Corp.'s bid to stop Northern Natural Gas Co. from seeking federal approval to expand its underground natural gas storage facility in Kansas.

The U.S. Court of Appeals for the Tenth Circuit affirmed Tuesday that a district court lacked jurisdiction to grant Trans Pacific’s motion to enjoin Northern from trying to obtain a certificate from the Federal Energy Regulatory Commission to expand its facility into Trans Pacific’s property.
