3rd Time's A Charm For Ex-Westar Honcho's Sentence

Law360, New York (June 18, 2008, 12:00 AM EDT) -- On the third try, an appeals court has affirmed a lower court's jail sentence for the former chief executive of public utility Westar Energy Inc. for bank fraud – two years.

A three-judge panel of the U.S. Court of Appeals for the Tenth Circuit said Tuesday that, this time, the sentence of David C. Wittig was appropriate. The same court had twice vacated and remanded Wittig's prior sentences of 51 months and 60 months, saying they were excessive.
