PTAB Rejects L-3 AIA Reviews For Failure To Show Prior Art

Law360, New York (November 18, 2014, 8:02 PM EST) -- The Patent Trial and Appeal Board on Friday denied bids from L-3 Communication Holdings Inc. to institute inter partes reviews of three Power Survey LLC patents related to sensing voltage anomalies, finding the communications company hadn’t shown a key report was prior art.

A three-judge panel of the U.S. Patent and Trademark Office’s PTAB said that L-3, along with co-petitioner Premier Utility Services LLC, had failed to show that a report regarding a voltage study carried out by the original applicant for the disputed patents, Sarnoff Corp., qualified as prior art.
