Greens Threaten Ky. Mining Co. Over CWA Reports

By David Siegel (November 17, 2014, 5:50 PM EST) -- An array of environmental groups on Friday threatened to sue Frasure Creek Mining LLC, claiming the company violated the Clean Water Act by falsifying reports about mountaintop removal mining-related pollution discharges into Kentucky waterways to escape potentially $1 billion in fines.

Appalachian Voices, Kentucky Riverkeeper Inc., Kentuckians for the Commonwealth and Waterkeeper Alliance sent a 60-day notice of intent to sue to Frasure, as required under the CWA, accusing the company of covering up nearly 28,000 violations of federal environmental law by submitting pollution reports to state and federal regulators that understated pollution levels following discharge events.
