Fed. Circ. Reverses $3M Scanner Technologies Fees

Law360 (June 19, 2008, 12:00 AM EDT) -- A federal appeals court has vacated $3.4 million in attorneys' fees and costs a lower court awarded to Belgium-based ICOS Vision Systems NV in a patent dispute brought by rival Scanner Technologies Corp., reversing part of the ruling that found Scanner had engaged in inequitable conduct but upholding the invalidity and noninfringement of the patents at issue.

The district judge had awarded the fees based on his determination that the case was exceptional because Scanner had misrepresented itself before the USPTO, but the appeals court disagreed....
