ProMedica Seeks Supreme Court Overturn Of Nixed Merger

By Tom Zanki (January 5, 2015, 8:16 PM EST) -- ProMedica Health Systems Inc. attorneys are urging the Supreme Court to overturn a Sixth Circuit ruling that blocked the Ohio-based health care organization's acquisition of a nearby hospital, saying appellate judges upheld a flawed regulatory ruling that concluded the merger harms competition.

Plaintiffs said the appellate court's April decision — which upheld the Federal Trade Commission's decision requiring ProMedica to divest Toledo-based St. Luke's Hospital on grounds the merger would likely result in higher prices on consumers — sets a dangerous precedent in a time when consolidation of health care operators is often necessary for economic survival.
