6th Circ. Reverses Race Bias Ruling In Baxter Suit

Law360, New York (July 3, 2008, 12:00 AM EDT) -- A federal appeals court has reversed Baxter Healthcare Corp.'s motion for summary judgment in a racial discrimination case and remanded the case for trial in Michigan federal court.

The ruling last Thursday in the U.S. Court of Appeals for the Sixth Circuit was a reversal of an earlier decision in the U.S. District Court for the Eastern District of Michigan, which found in March 2006 that there was not sufficent evidence for a trial in the case, in which the medical technology company allegedly discriminated against...
