State's EEOC Immunity Faces 9th Circuit Review

Law360, New York (July 7, 2008, 12:00 AM EDT) -- The U.S. Court of Appeals for the Ninth Circuit has ordered a full-panel rehearing of last year's ruling that Alaska's governor was immune from Title VII claims brought on behalf of state employees by the federal workplace regulator.

Chief Judge Alex Kozinski issued the order Thursday, saying the case would be reviewed en banc after a majority vote of nonrecused active judges of the court. The judge said last November's three-judge panel opinion should not be cited as precedent pending the outcome of the review....
