Splenda Scores Trade Dress Win V. Store Brands

Law360, New York (July 9, 2008, 12:00 AM EDT) -- McNeil Nutritionals LLC, the maker of artificial sweetener Splenda, has won an injunction in its trademark infringement lawsuit against rival Heartland Sweeteners LLC.

Judge John R. Padova of the U.S. District Court for the Eastern District of Pennsylvania handed down a preliminary injunction June 26 to prevent Heartland Sweeteners LLC and Heartland Packaging Corp. from making or distributing store-brand sugar substitute products that mimic Splenda's yellow packaging.
