Microsoft Will Fight to Stave Off Stiff Fine

Law360, New York (April 20, 2006, 12:00 AM EDT) -- With hundreds of millions of dollars hanging in the balance, Microsoft Corporation will appear next week before Europe’s second-highest court to challenge the legality of the European Commission’s March 2004 finding that the company exercised unlawful monopoly power.

The hearings are scheduled for April 24-28 in Luxembourg. If Microsoft’s arguments fail to sway the judges, the Court of First Instance will affirm the E.C.’s 2004 decision, which would mean that Microsoft will be liable for fines of as much as €2 million for each day it...
