Law360, New York (July 18, 2008, 12:00 AM EDT) -- An appeals court has reversed a summary judgment ruling that a U.S. Foreign Service candidate who was disqualified by the State Department after she was diagnosed with breast cancer had no “record” of a disability, finding that her inability to engage in sexual relations constitutes a limitation under federal employment laws.

The 2-1 opinion, filed Friday in the U.S. Court of Appeals for the District of Columbia, held that Kathy Adams had furnished “uncontroverted evidence” that the State Department was aware of her breast cancer history...
