Judge Denies AT&T Summary Judgment In USF Case

Law360 (July 21, 2008, 12:00 AM EDT) -- A federal judge on Thursday rejected AT&T Corp.'s second request for summary judgment in antitrust litigation over Universal Service Fund fees.

District Judge John W. Lungstrum of the U.S. District Court for the District of Kansas upheld the three aspects of his June 30 order that AT&T had challenged July 15.

"The court wishes to remark that it appreciates the vigor and thoroughness AT&T has exhibited in seeking summary judgment in this case ... even if the court has not discussed those arguments with the level...
