No Compensation For Arvin Worker's Disease: Judge

Law360, New York (July 22, 2008, 12:00 AM EDT) -- A state appellate judge has ruled that a former employee of auto parts supplier ArvinMeritor Inc. is not entitled to disability benefits for emphysema that he said he contracted from inhaling toxic fumes on the job, reversing a decision by a lower state court.

Judge Terri Willingham Thomas of the Court of Civil Appeals of Alabama ruled on Friday that Curtis Dale Johnson — one of several hundred employees who has sued ArvinMeritor for injury allegedly caused by fumes — had relied on improper expert testimony....
