Farmers Sue Allens Ch. 11 Pros For Priority $2.8M Fee Claim

Law360, New York (April 2, 2015, 4:08 PM EDT) -- Vegetable wholesalers asked the judge presiding over the liquidation of Allens Inc. to order the return of around $2.8 million from the frozen food manufacturer’s investment bank Wednesday under a little-known law affording farmers priority Chapter 11 repayment rights.

An adversary complaint filed in the converted Chapter 7 bankruptcy alleges that Lazard Freres & Co. LLC’s receipt of professional fees before and after Allens entered bankruptcy violates the Depression-era Perishable Agricultural Commodities Act.
